RULON, J.:

Haz-Mat Response, Inc., plaintiff, appeals the district court's granting of summary judgment to Coastal Refining & Marketing, Inc., defendant. Specifically, plaintiff claims the court erred in finding that removal of hazardous waste would not support a mechanic's lien and that a subcontractor could not recover from the owner of a property absent privity of contract. We affirm in part, reverse in part, and remand the cause for further proceedings.
