The defendant, pursuant to CPL 410.30, was charged with violating the conditions of his probation, as specified in Penal Law § 65.10 (2) (a), because of a conviction for the misdemeanors of assault and resisting arrest, and two convictions for the violations of operating a motor vehicle while his ability was impaired by the consumption of alcohol (DWAI).1
