I. Facts

While driving on November 2, 1990, Philip Murphy struck and seriously injured Marvin Iames, a pedestrian, who had walked onto Blue Rock Road. Philip Murphy was returning from delivering food for the Fifth Amendment restaurant owned and operated by Walt Byers. At the time of the accident, Iames, the pedestrian, had a blood-alcohol content close to three times the legal limit...
