BAKER, Judge.

Appellant-respondent Natural Resources Commission1 (NRC) brings this appeal from the judgment of the Montgomery Circuit Court which reversed an order of the NRC denying appellees-petitioners, Sugar Creek Mobile Estates, W. Nathan Pickett and Roscoe C. Moore (collectively Estates), after-the-fact permit to build an unformed concrete levee in the floodway along the bank of Sugar Creek.
