PEOPLE v. WYNN

222 A.D.2d 470 (1995)

635 N.Y.S.2d 53

The People of the State of New York, Respondent, v. Maurice Wynn, Appellant

Appellate Division of the Supreme Court of the State of New York, Second Department.

December 4, 1995

Ordered that the judgment is affirmed.

The prosecutor's statements during summation, which referred to the similarity of the circumstances of two robberies allegedly committed by the defendant and noted that the two robberies and the theft of services took place in the same location in the subway station, were not so prejudicial as to deprive the defendant of a fair trial (cf., People v DeJesus, 132 A.D.2d 564).
