Willie Wilks was the subject of a three count indictment which charged him with various drug trafficking offenses. Of these, only Count 2, which charged Wilks with attempting to possess one kilogram of cocaine with intent to distribute, carried a mandatory minimum ten year sentence upon conviction. 21 U.S.C. §§ 841(b)(1)(B), 846. Wilks trial counsel thus focused his attention on the second count, generally conceding his client's guilt...
