The defendant, Leonard Cummings, was charged by grand jury indictment with distribution of cocaine, in violation of LSA-R.S. 40:967. The defendant pled not guilty and, after trial by jury, was found guilty as charged. Thereafter, the State filed a habitual offender bill of information; and the defendant subsequently admitted to being a second felony habitual offender. The defendant received a sentence of fifteen years at hard labor. He has appealed...
