OPINION

LEDERBERG, Justice.

The State of Rhode Island (state) has appealed to the Supreme Court the dismissal of a criminal information lodged against Stephen M. DeAngelis (defendant). The appeal was taken after the Superior Court granted the defendant's motion to dismiss for lack of a speedy trial. We deny the state's appeal and affirm the judgment. The facts insofar as pertinent to the appeal are as follows.
