In this appeal, we consider for the first time in our circuit whether a city's anti-nepotism policy denies the fundamental right to marry protected by the Due Process Clause of the Fourteenth Amendment, infringes the right of intimate association implicit in the First Amendment, or has a disparate impact on women in violation of the Equal Protection Clause of the Fourteenth Amendment.
