On June 24, 1993, a federal grand jury returned a 38-count indictment charging appellant Mark A. Ferguson and twelve others with violations of the drug laws. The indictment charged Ferguson with (1) conspiracy to distribute cocaine and cocaine base in violation of 21 U.S.C. § 846 (Count 2), (2) possession of cocaine with intent to distribute in violation of 21 U.S.C. § 841(a)(1) (Count 4); (3) distribution of cocaine base in violation...
