Initially, contrary to the IAS Court, we find that the letter to the editor written by defendant-respondent John Mulvihill included implied assertions of fact (see, Gross v New York Times Co., 82 N.Y.2d 146, 153) clearly communicating the idea that the failure on the part of plaintiff, a well known Irish comedian, to appear at an event sponsored by Mulvihill was in wrongful breach...
