Petitioner George McGraw, in an unprovoked attack, beat his elderly landlord to death with a wrench on July 22, 1971 because he delusionally believed that the landlord had alienated him from his girlfriend. McGraw was charged with intentional murder but was ultimately adjudicated not guilty by reason of mental illness or defect and, after a hearing pursuant to CPL 330.20 (7), he was committed to the custody of the Commissioner of Mental Health.
