On these consolidated appeals the ultimate question presented for this Court's determination is whether defendant is entitled to a release order pursuant to CPL 330.20. Such an order would direct the New York State Commissioner of Mental Health (the Commissioner) to terminate defendant's continued in-patient status, without terminating the Commissioner's responsibility...
