MARTONE, Justice.

John Albert Hinchey was convicted of premeditated first degree murder and sentenced to death. We affirmed the conviction but vacated the death sentence and remanded for resentencing. State v. Hinchey, 165 Ariz. 432, 799 P.2d 352 (1990), cert. denied, 499 U.S. 963, 111 S.Ct. 1589, 113 L.Ed.2d 653 (1991). Hinchey was again sentenced to death. This...
