John and Teresa Brenton sued Arthur Pearson, Gilmer County and others for injunctive relief from trespass on their land. The complaint, filed by the Brentons' attorney, James Bass, alleged that Rogers Creek Road, a private road traversing the Brentons' property, was unlawfully declared to be a public road by the county.
