Herbert Henry Lynch (appellant) appeals his conviction in the district court1 under 18 U.S.C. § 111(a)(1) and subsequent sentence. For the reasons stated below, we affirm.

BACKGROUND

On July 5, 1994, appellant was a spectator in the courtroom of then District Court Judge Diana Murphy. The bench trial in progress concerned treaty rights of the Mille Lacs Band of the Chippewa Indians....
