Appellant, the state of Ohio, appeals the suppression motion granted in favor of appellee William Berry. For the reasons that follow, we affirm.

Appellee was sitting on a porch. Detective Thomas observed him walk to a car and hold a brief conversation with the occupant of the car. The car then drove off.
