These actions are brought by three children with asthma and a woman with lupus against two popular fast-food restaurant chains, McDonald's Corporation ("McDonald's") and Burger King Corporation ("Burger King"). Plaintiffs claim that defendants' policies of permitting smoking in their restaurants violate § 302 of the Americans with Disabilities Act, 42 U.S.C. § 12182 (the "ADA" or "Act").
