This action arises out of the dispute between appellant, city of Cleveland ("Cleveland") and appellee, city of Brook Park ("Brook Park"), concerning a parcel of land located within the municipal limits of Brook Park. The parcel of land at issue is approximately 14.8 acres of vacant land bearing permanent parcel No. 341-35-001 and is commonly referred to as the "Bence parcel."
