The defendant has made a motion pursuant to CPL 440.10 (1) (b), (f) and (h) for an order vacating the judgment of conviction on the grounds that the judgment was obtained in violation of his "constitutional rights, ineffective counsel, and the judgment was procured by trickery, deceit and prejudical [sic] conduct on the part of my assigned attorney".
