In July 1994, the Defendant pled guilty to one count of aggravated driving under the influence of alcohol with a blood alcohol content of .10 percent or more in violation of Arizona Revised Statutes Annotated ("A.R.S.") sections 28-692(A)(2) and 28-697(A)(1), a class four felony.
