Plaintiff, Margaret Kirk, appeals from a judgment of the Franklin County Court of Common Pleas in favor of defendant, Ron Edwards. Plaintiff sets forth the following assignment of error:

"The trial court erred to the prejudice of the plaintiff by granting summary judgment when there existed genuine issues of material fact in the record, and where the defendant-appellee was not entitled to judgment...
