Defendant-appellant, James M. Yarber, was indicted on three counts of rape and one count of gross sexual imposition. A jury trial was held on July 25 and 26, 1994, in which appellant was found not guilty on one count of rape and guilty on the other two counts of rape and the count of gross sexual imposition.
