Appellant asserts that the court of appeals erred in granting the writ of mandamus. In order to be entitled to a writ of mandamus, Waldick had to establish a clear legal right to have appellant execute the waterline engineering agreement noted in the ordinance, a corresponding clear legal duty on the part of appellant to do so, and the lack of a plain and adequate remedy in the ordinary course of law.
