Defendant is a Spanish-language newspaper. On November 18, 1992 it published an article about plaintiff, containing her picture and describing her as having AIDS. It is undisputed that at the time the article was published, plaintiff was HIV-positive and seriously ill with AIDS-related illnesses, having been extensively hospitalized for Bacillary Angiomatosis, pneumonia, and Disseminated Herpes Zoster infection.
