This appeal arises from an adversary proceeding brought by New York State's Special Prosecutor for Medicaid Fraud Control ("the State") to have debts owed by defendant Abraham I. Sokol, M.D. ("Sokol") declared nondischargeable. In 1992 a New York State Supreme Court jury convicted Sokol after a lengthy trial of violating N.Y. Penal Law § 155.40, grand larceny in the second degree (theft of over $50,000...
