Before the court are two motions to dismiss —one filed in each case. Pursuant to 28 U.S.C. § 636(b)(1)(B), the court referred all pretrial matters for both cases to the magistrate. Magistrate Rosemond signed his eleven page report and recommendation on August 1, 1995, addressing both motions.
