Appellant, Earl Frederick, was charged with First Degree Murder, in violation of 21 O.S. 1991, § 701.7, in the District Court of Oklahoma County, Case No. CF-90-734. The State filed a Bill of Particulars alleging two aggravating circumstances: that the murder was committed for the purpose of avoiding arrest or prosecution, and that Appellant constituted a continuing threat...
