This action is before the court on the motions to dismiss the complaint of plaintiff Michael Pope by defendants Inland Property Management ("IPM") and Martin Boyer Company, Inc. ("Boyer"). Both IPM and Boyer move to dismiss the complaint for failure to state a claim upon which relief can be granted, pursuant to Fed.R.Civ.P. 12(b)(6).
