BYRNES, Judge.

Kevin Fenner appeals his conviction and suspended three-year sentence for negligent homicide. We reverse.

On October 5, 1992 at approximately 6:00 p.m., the defendant, Kevin Fenner, a New Orleans police officer, was dispatched with his partner, Officer Joel Tallant, to Stemway Drive and Warfield Street to investigate a report that a possibly armed young black male named "Virgil" was selling drugs...
