SUMMERS, Justice.

This is a suit by an automobile buyer against the company that sold him the car and the company's owner. Plaintiff seeks, in the alternative, the remedies of rescission or damages for breach of warranty. He claims the defendants sold him a used car as new. The trial court granted summary judgment in favor of both defendants, and plaintiff appealed. The Court of Appeals affirmed and we have granted certiorari...
