The appellant, Robert Mitchell McCollum, was convicted by a jury of manslaughter, a violation of 13A-6-3(a)(2), Ala.Code 1975, as charged in the indictment, for killing James Kittrell. He was sentenced to a 15-year split sentence, and was ordered to serve 1 year in the penitentiary and the balance on probation. He appeals from that conviction.
