Defendant Bryan Memorial Hospital has filed a motion for partial summary judgment (filing 25) and a motion to dismiss. (Filing 29.) For the reasons discussed more fully below I shall grant the motion for partial summary judgment in part and grant the motion to dismiss in part.1
