Plaintiff, Viola P. Goodbee, appeals the granting of defendants' ex parte Motion and Order to Dismiss, based on the plaintiff's failure to join an indispensable party. The salient issues in this case can be narrowed to two: 1) Under LSA-C.C.P. art. 801, are all members of a LSA-C.C. art. 2315.1 class of legal successors indispensable parties in a personal injury action brought by a now deceased plaintiff prior to her death?
