The appellant, Larry Walton, was originally charged by indictment with second degree murder, § 565.021.1(2), RSMo 1994, first degree robbery, § 569.020, RSMo 1994, and two counts of armed criminal action, § 571.015, RSMo 1994. The indictment was later amended by information charging Mr. Walton with the same counts and asserting him to be a prior, persistent and class X offender, § 558.016, RSMo 1994, and § 558.019, RSMo 1994...
