This is an appeal by the plaintiff from a summary judgment for one of the defendants in a wrongful death action. Darren DeStevens was killed by electrocution. He was using a scaffold to do work on the property of Sears, Roebuck and Company when the scaffold touched a powerline. His widow, Susan Ann DeStevens, sued Sears, the scaffold manufacturer and New Orleans Public Service, Inc. (NOPSI), the electric utility operating the powerline. Sears moved...
