650 So.2d 1035 (1995)

Douglas ATKINSON, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Fifth District.

Rehearing Denied March 7, 1995.

Attorney(s) appearing for the Case

James B. Gibson, Public Defender, and S.C. Van Voorhees, Asst. Public Defender, Daytona Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, Timothy D. Wilson and Belle B. Turner, Asst. Attys. Gen., Daytona Beach, for appellee.
