Appellant Rory Martin Campbell was indicted on one count of burglary of a habitation in violation of TEX.PENAL CODE ANN. § 30.02 (Vernon 1989). He was charged with breaking and entering the home of Kathy and Phillip Mitchell and stealing from them several objects, including a refund check from the Internal Revenue Service made payable to both Kathy and Phillip that Campbell eventually cashed at a motorbank in Killeen.
