Defendant Caterpillar Brasil, S.A. ("Caterpillar Brasil") filed a motion to dismiss for lack of personal jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(6). Caterpillar maintains that it does not possess the requisite minimum contacts necessary for this court to invoke jurisdiction.
