On November 30, 1988, Larry Heard was convicted on one count of possession of marijuana and one count of possession of cocaine. He was sentenced to 15 years' imprisonment. Over three years later, on December 20, 1991, Heard filed a petition for postconviction relief under Rule 32, Ala.R.Cr.P., alleging that Count 1 of the indictment, which charged him with possession of marijuana, was void because it cited the wrong Code section.
