James Patrick Kennedy (Appellant) was charged with murder in the second degree and armed criminal action arising from an altercation in which Cody Warner (Cody) was killed. This appeal is from his conviction, by a jury, of the lesser included offense of involuntary manslaughter, § 565.024, RSMo 1986, and armed criminal action, § 571.015, RSMo 1986, which resulted in his being sentenced to consecutive terms of seven and eight years...
