This is a first degree murder case in which Defendant John J. Fekete appeals the judgment and life sentence the district court entered after the jury reached a verdict of guilty but mentally ill. Fekete raises the following issues on appeal: (1) whether substantial evidence supports the element of deliberate intent for first degree murder; (2) whether the trial court erred in refusing to give his tendered jury instruction...
