OPINION

YATES, Justice.

Appellant, the State of Texas, appeals from an order granting appellee, Linda Susan Hart's, motion for new trial. Hart was convicted by a jury for the offense of theft and sentenced by the court to 180 days, probated for 180 days. Appellee filed a motion for new trial which was granted by the trial court. We reverse.
