PEOPLE v. BYRON

No. 72174.

647 N.E.2d 946 (1995)

164 Ill.2d 279

207 Ill.Dec. 453

The PEOPLE of the State of Illinois, Appellee v. Robert BYRON, Appellant.

Supreme Court of Illinois.

Rehearing Denied April 3, 1995.

Attorney(s) appearing for the Case

Michael B. Metnick and Richard D. Frazier, Metnick, Wise, Cherry & Frazier, Springfield, for appellant.

Roland W. Burris, Atty. Gen., Springfield, and Jack O'Malley, State's Atty., Chicago (Arleen C. Anderson, Asst. Atty. Gen., Chicago, and Renee Goldfarb, Michael Golden and Janet Powers Doyle, Asst. State's Attys., of counsel), for the People.

Justice HEIPLE delivered the opinion of the court:

The defendant, Robert Byron, was indicted for murder, conspiracy to commit murder, home invasion, and armed robbery. He was tried in a joint trial with codefendant Harold Bean. A jury found them guilty of all charges, and both defendants were sentenced to death. Subsequently, we reversed those convictions and remanded the causes for separate trials because the defenses of the two codefendants were antagonistic.
