The United States appeals the judgments of acquittal of Tovar-Rico (Tovar) and Isabel Romeo (Romeo), and the sealed verdict of Luis Figueroa Marmolejo (Figueroa) who is a fugitive, all of whom were charged with conspiracy to possess cocaine with intent to distribute in violation of 21 U.S.C. § 846 (Count 1) and possession of cocaine with intent to distribute in violation of 21 U.S.C. § 841(a)(1) (Count 2).
