Before the Court are plaintiff's motion to remand the above-captioned action to state court and defendants' motion to dismiss the action for failure to state a claim upon which relief can be granted. Because the Court finds that the action was not properly removed to this Court, plaintiff's motion to remand will be granted and the Court does not reach the merits of defendants' motion to dismiss...
