Appellant, Erwin L. Davis, appeals a judgment of the Washington County Chancery Court finding him the father of a minor child, Kerwin Mikhail Lee Sheppard, born out of wedlock on December 10, 1990, and ordering him to pay support for the child. Appellant's sole assignment of error is the trial court's denial of his motion to dismiss pursuant to ARCP Rule 41 for prior dismissal with prejudice of the same action.
