Michael Hayes appeals the district court's order denying his habeas petition filed pursuant to 28 U.S.C. § 2254. The district court concluded that Mr. Hayes was no longer in custody pursuant to the conviction that was the subject of his original petition, because the state court had since reversed that conviction. The court further concluded that he had failed to exhaust his state remedies with respect to his subsequent retrial and reconviction...
