MEMORANDUM OPINION AND ORDER

BUCKLO, District Judge.

Plaintiff, Affiliated Capital Corporation ("Affiliated"), has filed a motion for summary judgment to which defendants, Frederick A. Buck ("Mr. Buck") and Medical and Surgical Health, Inc. ("MSHI"), did not respond. For the reasons discussed below, Affiliated's motion is granted.
