In cause number 3-95-385-CV, Relator BWI Companies, Inc. seeks mandamus relief to enforce an arbitration agreement signed by Patrick Kurtenbach, the plaintiff and real party in interest in the proceeding below. Because we hold that Relator has established that the agreement is enforceable under the Federal Arbitration Act, and that Kurtenbach's claim falls under the agreement, we conditionally grant the relief requested.
